Carol Wang is Head of Shanghai Office, Co-Deputy Head of Dispute Resolution at Lusheng Law Firm. Carol has abundant experience advising on IP protection strategies in China.
She has particular expertise in relation to copyright and design protection, well-known trade mark recognition, patent prosecution and litigation, and unfair competition laws, and has managed brand protection programs for several major clients.
Having worked closely with clients on all aspects of IP, she has developed an in-house perspective which enables her to help them develop IP strategies that meet their business needs.
Her clients include the world's well-known companies from Europe, North America, etc. and covering industries of fast-moving consumer goods, luxury, fashion, entertainment, industrial commodity manufacturing and many other fields. She is a regular contributor to IP magazines and journals including Managing Intellectual Property, Copyright World and China Law and Practice.
Carol has handled landmark cases in China, some of which received awards from courts and industrial organisations. Examples include:
- New Balance vs New Barlun case, which was ruled by Shanghai Pudong court in favor of New Balance, awarding the Defendant to pay RMB10.8 million to the Plaintiff, which aroused great media attention and was considered to be one of the most significant cases representing China’s solid judicial IP protection to the international brands.
- Spin Master vs Lingdong, an invention patent dispute, which judgement was handed down this March, where the court awarded damages of RMB15.5 million to the Plaintiff. This case was believed to be the highest damages to foreign patent holder in the mechanical field.
- Timberland vs Zhongshan Tongye, which was ruled in favor of the Plaintiff by the second instance Hangzhou Intermediate Peoples’ Court. Timberland’s iconic yellow boot get up and its Chinese nickname are successfully protected under Anti-Unfair Competition Law.
- Burberry vs Feacome, where the Plaintiff successfully attacked a parallel import products’ distributor, who tried to piggyback the Plaintiff’s famous decration and its trademark right in class 35.
