On 11 June, Lusheng Law Firm, together with its strategic partner Rouse and Arnold & Siedsma, a European intellectual property firm under the Rouse Group, successfully held the IP Gathering Seminar “Corporate IP Going Global: Layout and Practical Response Strategies between China and Europe” at The St. Regis Shenzhen Bay OCT in Qianhai, Shenzhen.
The seminar brought together representatives from numerous enterprises in the Greater Bay Area, focusing on such hot topics as European patent portfolio planning, global patent strategies, responses to cross-border litigation, protection of trade secrets, and administrative enforcement for patent protection.

Gerwald Verdijck, Partner at Arnold & Siedsma, first introduced the key points in building a patent portfolio in Europe, including an overview of the European patent application process, a brief introduction to opposition proceedings, and a comparison between EPO oppositions and the UPC. He then analysed the necessity of improving patent quality to achieve high impact, illustrating common issues that lead to a reduction in the scope of protection or impact with specific examples, and focused on how enterprises can enhance patent quality and commercial value through an “Early Certainty” strategy.
During the presentation, many participants actively raised questions and engaged in lively interaction on related topics, further deepening their understanding of European patent practice.

Wang Huaizhang, Head of China Patent Practice, Lusheng Law Firm
Attorney Wang Huaizhang, Head of China Patent Practice at Lusheng, provided an in-depth presentation on the overall approach and implementation strategies for enterprises’ global patent portfolio planning. Attorney Wang noted that enterprises’ outbound patent strategies must serve their business strategies, and conducted comparative analyses using case studies of enterprises in the EV, telecommunications, AI chips, and new energy battery sectors. Based on the two core concepts of “risk containment” and “opportunity expansion,” he elaborated on common risks such as market access and technology leakage, as well as how patents can be transformed into licensing revenue, negotiation leverage, and brand value. He also proposed criteria for screening high-value patents from legal, technical, and market perspectives, and analysed the characteristics of patent application systems in major target markets.

Subsequently, Partner Michiel Rijsdijk of Arnold & Siedsma joined the seminar online and provided an in-depth presentation on the court inspection proceedings and evidence rules in the Netherlands, Germany, France, and the Unified Patent Court (UPC), explaining key practical points such as ex parte inspection orders, the probative value of expert evidence, and the protection of confidential information in different jurisdictions.

With the continued rise of the Southeast Asian market, Vietnam has become a key overseas destination for Chinese enterprises. Drawing on local practical experience, Huy Nguyen, Senior Lawyer at Rouse’s Vietnam office, provided an in-depth introduction to the mechanisms for resolving patent infringement disputes in Vietnam, covering civil litigation procedures, evidentiary requirements, standards for determining infringement, and the main challenges faced by right holders in the course of rights enforcement. He also analysed the development trends of local judicial practice through typical cases, helping participants gain a deeper understanding of IP risk management and enforcement strategies in Vietnam.

Attorney Xu Liping, Head of Patent Litigation at Lusheng, conducted an in-depth analysis of the latest characteristics and trends in trade secret cases in recent years, and, in light of judicial practice, discussed the challenges enterprises face in protecting R&D achievements, managing employees, protecting data assets, and preserving evidence. He pointed out that the core of building a corporate trade secret system lies in employee management, and that a comprehensive protection system needs to be established through institutional development, process management, and risk early-warning mechanisms, thereby reducing the risk of leaks at the source.

In light of recent developments in administrative law enforcement practice, Attorney Hou Heng, Director of Lusheng’s Guangzhou office, introduced the advantages and legal basis of administrative law enforcement in patent infringement disputes, as well as the applicable scenarios for patent administrative complaints, infringement investigations, and administrative handling procedures. By presenting typical patent infringement cases handled by Lusheng in Zhejiang, Tianjin, Shanghai, and other regions, he demonstrated the practical effectiveness of administrative enforcement in swiftly stopping infringement, facilitating settlements, and securing compensation.
